Terms & Conditions of Purchase
|
(1) The following terms and conditions apply to all purchases of products available on the www.BTCSoftware.co.uk Web-Site over the Internet. Please scroll through this screen and print a copy for your future reference.
(2) These terms and conditions shall apply to all contracts for the purchase of products to the exclusion of all other terms and conditions including any terms or conditions which you may purport to apply under any sales offer. Your registration with BTCSoftware and/or your use of the BTCSoftware web site constitutes your acceptance of and your agreement to be bound by these terms and conditions.
(3) No contract will exist between you and BTCSoftware for the sale by it to you of any product unless and until BTCSoftware accepts your order by email by confirming that it has despatched or shipped the goods and/or provided the licence keys ordered by you. Acceptance of your order will take place and will be deemed to have been communicated to you at the time BTCSoftware sends the email confirming receipt of your order (whether or not you receive that email). For the avoidance of doubt, the contract will be deemed to have been concluded in the United Kingdom.
(4) BTCSoftware may at its sole discretion offer software and services on a monthly subscription basis. When a subscription order is accepted it is for a period of 12 months. There is no commitment from BTCSoftware to offer, nor commitment from you to accept, a new subscription at the end of the 12 month term. BTCSoftware will take two twelfths of the total purchase price at time of order followed by ten monthly instalments representing one twelfth of the total purchase price commencing two months after the date of order and monthly thereafter until cancelled by either party. All payments are subject to VAT at the standard rate applicable at the time of each monthly invoice. BTCSoftware may cancel your subscription by giving ninety (90) days prior written notice. You may cancel your subscription by giving ninety (90) days prior written notice. Note that our P11D Solutions are not available on a monthly subscription basis.
(5) Our web site is subject to constant development. Prices and content are subject to change without notice. BTCSoftware does not represent or warrant that the information on this web site is accurate, complete or current. All products are subject to availability and may be withdrawn by BTCSoftware at any time.
(6) Prices are quoted in £sterling and are exclusive of Value Added Tax. Value Added Tax will be added, where applicable, at the checkout stage at the current rate.
(7) Where physical dispatch is relevent, we only ship to addresses in the UK. All deliveries are sent by 1st class post. Stock permitting, we will endeavour to ship all orders received before 12.00 noon Monday to Friday (excluding English Bank Holidays) by the end of the next working day.
(8) BTCSoftware reserve the right to change any price before you place an order. BTCSoftware endeavour to ensure that all prices quoted on the BTCSoftware Web-Site are accurate and will check the prices at the time of processing your order. In the unlikely event, however, that a products price is higher than the price quoted, BTCSoftware will contact you for your instructions prior to processing your order. Payment is required in advance of delivery.
(9) All products purchased from BTCSoftware are bought according to a contract of sale which includes these terms and conditions.
(10) You may return unused products to us provided we are notified of the return within 7 days of receipt. Further, we will, at our sole discretion, extend this to a period of 60 days where the software is used by a bona-fide accountant in practice or commerce. Please contact us by email to Sales@BTCSoftware.co.uk for all returns enquiries. This condition does not affect your statutory rights.
(11) When you place orders or access your account information, BTCSoftware may use a secure server. If so, the secure server will encrypt all information which is entered by you before it is sent to BTCSoftware. "Cookies" are those pieces of information that are stored by your browser on the hard drive of your PC and refer also to those pieces of information which are stored by the server for the benefit of BTCSoftware. Web browsers automatically accept Cookies. You can, however, change your browser to prevent Cookies from being stored.
(12) BTCSoftware is required under the UK Data Protection Acts 1984 and 1998 to comply with conditions relating to the storage and disclosure of personal information relating to you to prevent access by unauthorised parties. BTCSoftware uses the information which BTCSoftware hold about you to process your order. BTCSoftware does not sell, trade or relay your personal information to others. BTCSoftware may share your personal information with other organisations to assist in the prevention of fraud. (13) By using the BTCSoftware Web-Site you expressly consent to the use and collection of information about you by BTCSoftware.
(14) BTCSOFTWARE PROVIDES THIS WEB-SITE AND ITS CONTENTS ON AN "AS IS" BASIS AND TO THE FULLEST EXTENT PERMITTED BY LAW MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THIS WEB-SITE OR ITS CONTENTS INCLUDING, WITHOUT LIMITATION, WARRANTIES IN RESPECT OF ANY PRODUCT SOLD BY BTCSOFTWARE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SAVE AS HEREIN SPECIFIED ALL EXPRESS OR IMPLIED REPRESENTATIONS, TERMS AND CONDITIONS ARE HEREBY EXPRESSLY EXCLUDED TO THE FULLEST EXTENT PERMISSIBLE BY ANY LAW.
(15) This contract will be construed, interpreted and enforced in all respects in accordance with English law and you and BTCSoftware submit to the exclusive jurisdiction of the English Courts.
